JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 20-06-2017 Heard learned counsel for the appellant as well as learned Special Public Prosecutor.

At an earlier occasion while rejecting prayer for bail vide order dated 12.11.2014 under Cr. Misc. No.29126 of 2014 (Annexure-1) a liberty was granted to the appellant to renew after examination of two witnesses, namely, Deo Kumar as well as Sumit Kumar. Those witnesses have not been examined as yet.

Learned counsel for the appellant has submitted that charge has been framed on 05.03.2016 and since thereafter, not even a single witness has been examined. That being so, the learned lower court will act in accordance with law whereunder the court is empowered to take proper step for procurement of presence of the witnesses.

Patna High Court CR. APP (SJ) No.941 of 2017 (5) dt.20-06-2017 With the aforesaid observation, instant petition is disposed of.
