1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The learned counsel submits that the petitioner was granted the privilege of anticipatory bail by order dated 24.04.2024 in Cr. Misc. No.22573/2024 with a condition that one of the bailor of the petitioner shall be his father Baleshwar Sonar. It is submitted that the petitioner filed the instant modification application seeking modification of the order dated 24.04.2024 in Cr. Misc. No.22573/2024, within the time stipulated for surrender on the ground that inadvertently in Cr. Misc. No.22573/2024, the petitioner was described as son of Baleshwar Sonar, when it ought to have been son of Late

Patna High Court CR. MISC. No.49090 of 2024(2) dt.05-07-2024 2/2 Baleshwar Sonar. It is further submitted that the father of Om Prakash Sonar @ Omprakash Sonar died on 03.02.2021, as would manifest from the death certificate (Annexure-P2).

3. In view of the submission made by the learned counsel appearing on behalf of the petitioner, the condition imposed by order dated 24.04.2024 in Cr. Misc. No.22573/2024 is modified to read as that "one of the bailor of the petitioner no.3 Om Prakash Sonar @ Omprakash Sonar shall be his uncle Chandrama Prasad."

4. The order dated 24.04.2024 in Cr. Misc. No.22573/2024 is modified to the extent as indicated above.

5. In the event, if the petitioner surrenders on or before 22.07.2024, his anticipatory bail bonds shall be accepted provided one of his bailor is his uncle Chandrama Prasad. (Satyavrat Verma, J) amit/- U T
