The petitioner seeks anticipatory bail in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.
The case has been instituted by the Block Development Officer of Barari Block alleging that the petitioner availed the benefit of Indra Awas Yojana, Lok Shichhak under the government scheme by changing his name and identity and thus committed offence.
It is the case of the petitioner that way back on 18.05.2011, the petitioner had instituted a complaint case against the Block Programme Officer for not implementing the government schemes. He submits that the present First
Patna High Court Cr.Misc. No.43127 of 2014 (2) dt.20-03-2015 2/3 Information Report has been instituted on 01.04.2014 after the Court took cognizance on 15.01.2014 in Complaint Case No. 1094 of 2011. The learned counsel for the petitioner submits that the present case has been instituted out of vengeance in order to teach the petitioner a lesson for instituting the said complaint case.
Be that as it may, keeping in view the nature of allegation against him, let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Katihar, in connection with Barari P.S. Case No. 46 of 2014, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure with additional condition that the petitioner shall present himself before the court below as and when required and in case of failure on two consecutive occasions, his bail bonds shall be liable to be cancelled.
