In this case, the petitioner is apprehending her arrest in connection with Arrah Nawada Town P.S. Case No. 102 of 2019 registered for offences under sections 406, 420, 468 and 34 of the Indian Penal Code.

The Complainant is the elder brother of the petitioner who has lodged a criminal case stating that after death of his father, the mother lost her mental balance, taking benefit of the mental condition, the petitioner under the conspiracy sold the land to one Indu Devi, the accused no.2.

Learned counsel for the petitioner submits that in

Patna High Court CR. MISC. No.37744 of 2019(2) dt.21-06-2019 2/2 fact the mother was admitted in the Ruban Hospital, she was under treatment and, for that, the money was required, on that account, the land has been transferred by her for her treatment. Looking to the entire facts and circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Arrah Nawada Town P.S. Case No. 102 of 2019 arising out of Complaint Case No. 2261 (C) of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, she will remain present and if she would not present herself, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
