The petitioner seeks bail in Kodhobari P.S. case No. 5/2018, corresponding to Sessions Trial No. 125/2018, registered u/s 302, 304B of the IPC.

The petitioner is the husband of the deceased. Prayer for bail of the petitioner was earlier rejected by this court vide order dated 18.12.2019 passed in Cr. Misc. No. 70823/2019. The petitioner again moved this court for grant of bail. A report was called for with regard to stage of trial. The learned Additional Sessions Judge-II- Kishanganj reported that out of 11 prosecution witnesses eight witnesses have already been examined and this fact itself shows that the trial is at fag end.

Patna High Court CR. MISC. No.37663 of 2020(4) dt.23-03-2021 2/2 Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.

The trial court is directed to expedite the trial and conclude the same within three months from the date of receipt of this order.
