The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 306, 500, 504 and 509 of the Indian Penal Code and section 67(A) of the IT Act.

As per the prosecution case, this petitioner sexually assaulted the sister of informant as a result whereof she committed suicide.

It is submitted that as a matter of fact, there was love affair between the petitioner and the deceased. Both of them are of different religion and the family members of victim were not ready to marry her with the petitioner and out of frustration she

Patna High Court CR. MISC. No.39279 of 2022(2) dt.24-11-2022 2/2 committed suicide. Petitioner has not instigated or abetted the deceased. Moreover, this case has been lodged after inordinate delay of 23 days without any plausible explanation. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VII, Gopalganj in connection with Kuchaikot P.S. Case No. 70 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
