The petitioners are apprehending arrest in a case registered for the offences punishable under Section 409/34 of the Indian Penal Code.
It is alleged against the petitioners that being Assistant in the circle office of Bettiah they failed to handover the record of Settlement Case No.03/95-96, Rent Determination Case No.62/62-63 and Encroachment Case No.3/05-06 at the time of their transfer from the circle office of Bettiah. It is submitted by learned counsel for the petitioners that charge of above records were not given to the petitioners and the said fact has also surfaced during investigation, which also reflects from the impugned order, as has been recorded in
Patna High Court Cr.Misc. No.9969 of 2015 (2) dt.22-04-2015 2/2 paragraph nos. 19 to 22 of the case diary. It also reflects from the impugned order that no departmental proceeding has been initiated against the petitioners till date. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, West Champaran at Bettiah in connection with Bettiah Muffasil P.S. Case No.141 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
