JUSTICE ARUN KUMAR ORAL ORDER 07-02-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 272, 273, 420 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is alleged that one bottle wine and 30 litres of illicit country made liquor were recovered from the house of accused persons.

It is submitted that this recovery is not from the possession of the petitioner. It was recovered from open place and the said land does not belong to the petitioner and he has got no criminal antecedent.

Having considered the said facts and circumstances,

Patna High Court Cr.Misc. No.5747 of 2017 (2) dt.07-02-2017 2/2 in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Sanjay Singh be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-III, Gopalganj in connection with Baikunthpur P.S. Case No.171 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Arun Kumar, J) N.H./- U T
