24-11-2021 Heard learned counsel for the parties.
The petitioners seek bail in Muffasil P.S. Case No. 292 of 2021, registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act and Section 120(B) of I.P.C. 630 liters of foreign liquor has been recovered from a pick-up van, of which, petitioner no. 1 was driver and petitioner no. 2 was cleaner and both were apprehended on spot. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioners. Petitioners, being driver and cleaner respectively, were not aware about the nature of consignment, which was being transported in the said vehicle. Petitioners claim clean antecedent and they are in custody since 22.05.2021.
Patna High Court CR. MISC. No.49503 of 2021(2) dt.24-11-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.
Considering the nature of allegation, period of custody and clean antecedent of petitioners, the bail petition of petitioners is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 2nd cum Special Judge (Excise Act), Begusarai in connection with Muffasil P.S. Case No. 292 of 2021.
