Earlier the respondents have taken the stand that the issue of promotion is kept in abeyance, in view of the fact that matter as to the validity of the 2006 Rules is pending before the Apex Court.
Learned counsel appearing on behalf of petitioner submits that the Apex Court has already decided the issue therefore, the respondents may be directed to take final decision with regard to the claim of the petitioner for grant of promotion.
Patna High Court CWJC No.12271 of 2019(3) dt.15-10-2019 2/2 Considering the aforesaid, the writ petition is disposed of with a direction to the respondents to take appropriate decision for grant of promotion with all consequential benefits, keeping in view that earlier the petitioner was granted promotion, but the promotion was subsequently cancelled by the respondents vide Annexure-6.
Necessary decision in this regard must be taken by the respondents with all consequential benefits within a maximum period of 60 days from the date of receipt/production of a copy of this order. Annexure-6 shall not come in the way of respondents taking appropriate decision.
With the aforesaid, the writ application stands disposed of.
