In this application for anticipatory bail the petitioner apprehends his arrest for the offences punishable under sections 406, 420, 467, 468, 471 and 120 (B)/34 of the I.P.C. The petitioner being brother of Bijendu Prakash is named in the F.I.R. with allegation that when the amount was given he was with his brother and further both kept confined in a room for five days and got his signature on several papers and refused to pay money to him.
Submission is of false implication and that the informant has already entered into compromise and the main accused Vijayendra Prakash @ Vijondra @ Vijendu Prakash has
Patna High Court Cr.Misc. No.19584 of 2015 (3) dt.25-06-2015 2/2 already been acquitted vide Annexure-3 in G.R. No. 3504 of 2013, Trial No. 5075 of 2014. Co-accused Akhilesh Kumar Singh has already been allowed pre-arrest bail vide Cr. Misc. No. 18632 of 2014 by order dated 11.07.2014 and as such the petitioner deserves sympathetic consideration.
Be that as it may, as the main accused has already been acquitted and co-accused has been allowed pre-arrest bail and as such the petitioner in case of his arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Saran at Chapra in Bheldi P.S. Case No. 131 of 2013, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
