JUSTICE SUDHIR SINGH ORAL ORDER 09-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 366(A)/34 of the Indian Penal Code. The prosecution story, in brief, is that on 4.1.2015 at about 7 P.M. the informant's daughter went western side of his house to meet call of nature but she did not return home. During the course of search the informant came to know that accused Md. Anwar with the help of other accused caught her, put cloth into her mouth and kidnapped her for some illegal purpose. It has been submitted on behalf of the petitioner that the main allegation is against Md.Anwar, who is said to have eloped with the victim. There is no specific allegation against him. It is further submitted that the girl has been recovered.
Patna High Court Cr.Misc. No.19580 of 2015 (3) dt.09-07-2015 On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the fact that the main allegation is against one Md.Anwar, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri R.K.Sinha, learned Judicial magistrate, 1st Class,Purnea, in connection with Amour P.S.Case No. 05 of 2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
