JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Bettiah Muffasil (Banuchhapr) P.S. Case No. 240 of 2016, registered under Sections 413 and 414/34 of the Indian Penal Code. The accusation is that four persons were seen on two motorcycles in suspicious condition by the Police then they were chased and on chase two persons were apprehended by the Police with one motorcycle, whereas two persons succeeded in fleeing away on other motorcycle. The apprehended persons disclosed their names as Sunny Patel and Ravi Patel. They also disclosed that they used to do the business of selling of stolen motorcycle and they also disclosed the name of their two

Patna High Court Cr.Misc. No.14202 of 2017 (2) dt.07-04-2017 2/2 associates as Satyendra Kumar and Sonu Kumar (Petitioner). Learned counsel for the petitioner submits that it would appear from the F.I.R. that the name of the petitioner has come in the confessional statement of Sunny Patel and Ravi Patel and petitioner has not been apprehended by the Police on the spot and he is in custody since 30.01.2017. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, West Champaran, Bettiah in connection with Bettiah Muffasil (Banuchhapar) P.S. Case No.240 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
