JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-08-2019 This is an application for grant of anticipatory bail in connection with Katoria P.S. Case No. 24 of 2019 disclosing offences under Sections 366A/34 of IPC.

Prosecution story is that the minor daughter of the informant had gone to the school and thereafter, she did not return, later on, he came to know that one Saddam Ansari and 45 unknown person enticed her away and get confined her in the house of the petitioner.

Submission of the learned counsel for the petitioner is that her statement has been recorded under Section 164 of Cr.P.C. which disclosed the allegation against other accused and only allegation against this petitioner is that Saddam Ansari has brought the victim girl in her house and except that no other allegation has been attributed against this petitioner.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Sri Roshan Kumar, learned Judicial Magistrate, 1st Class, Banka, in connection with Katoria P.S. Case No. 24 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
