The petitioner has preferred this application for grant of regular bail in a case registered under sections 20 and 22 of the NDPS Act .

As per the prosecution case, 5 gms of brown sugar was recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the petitioner's possession who has been falsely implicated in the case. There is no FSL report on record. The petitioner is in custody since 1.3.2021 and has no criminal antecedent. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the

No.48588 of 2021(3) dt.09-03-2022 2/2 petitioner, the petitioner not having any criminal antecedent and having remained in custody for 1 year, the petitioner is directed to be enlarged on bail in connection with Special Case (NDPS) no. 23 of 2021 (arising out of Phulwarisharif P.S. Case no. 204 of 2021) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge XVIII, Patna.
