The petitioner has renewed his prayer for bail in a case registered under sections 30(a) and 30(d) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, on a raid being conducted 15 litres of liquor was recovered from the gumti of the petitioner.

It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 11.3.2022 (Annexure-1) passed in Cr. Misc. no.57157 of 2021 giving liberty to the petitioner to renew his prayer for bail on completing one year in custody. The petitioner is in custody for more than one year since 13.7.2021.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, liberty granted to the petitioner in the earlier order of rejection dated 11.3.2022 and the petitioner petitioner having remained in custody for more than one year, the Court directs the petitioner to be enlarged on bail in connection with Bakhari P.S. Case no. 197 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned I/C Exclusive Excise Judge-II, Begusarai.
