The petitioner seeks bail in Mairwa P.S. Case No. 80/2016, registered for the offences punishable under Sections 379, 411 of the Indian Penal Code.
The informant lodged the case against unknown for theft of his motorcycle bearing registration no. BR29J9873. During the course of investigation, the police saw the petitioner and two others moving on the aforesaid motorcycle, but after seeing the police, the petitioner and others started fleeing away. The petitioner was apprehended on chase and the motorcycle was recovered in front of the house of Rukshad Khan. Learned counsel for the petitioner submits that the motorcycle was not recovered from the conscious possession of
Patna High Court Cr.Misc. No.14929 of 2017 (2) dt.20-04-2017 the petitioner. It is false to say that the petitioner was moving on the aforesaid stolen motorcycle. It is submitted that the petitioner has got no criminal antecedent and he is in jail since 31.05.2016. Considering the facts aforesaid and the fact that the petitioner has got no criminal antecedent and he is in jail for about 11 months, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VII, Siwan in connection with Mairwa P.S. Case No. 80/2016.
