The petitioner seeks bail in connection with Dalsingsarai P.S. Case No.351 of 2016 registered under Sections 302 and 394 of the Indian Penal Code besides Section 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner and one Rohit Kumar alias Rohit Kumar Choudhary surfaced in this case in the

Patna High Court Cr.Misc. No.5703 of 2017 (3) dt.12-04-2017 2/2 confessional statement of the co-accused Golden Kumar as liner without showing any specific overt act. The petitioner is in custody since 08.11.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Samastipur, in connection with Dalsingsarai P.S. Case No.351 of 2016.
