The petitioner has renewed his prayer for bail in connection with Barahiya P.S. Case no. 10 of 2019 registered under section 307 of the Indian Penal Code and section 27 of the Arms Act.

As per allegation in the FIR, the petitioner is stated to have fired from his pistol hitting the informant in his chest, which is confirmed from the injury report that has transpired in course of investigation.

It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 18.3.2020 (Annexure-1) passed in Cr. Misc. no. 85089 of 2019. The petitioner is in custody since 19.7.2019 and

Patna High Court CR. MISC. No.35966 of 2020(4) dt.03-02-2021 2/2 there has been no progress in the trial. There is no chance of the trial concluding in the near future.

A report was called for from the learned Trial Court and the same has been received. As per the report, charge has been framed and the case is pending for evidence. Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner which is confirmed from the injury report, the Court is not inclined to enlarge the petitioner on bail and, as such, the same is rejected.
