Petitioner is in custody since 18.01.2017 in connection with Bathnaha P.S. Case No. 15 of 2017 registered under Sections 363, 302, 120(B) of the Indian Penal Code.
Learned counsel for the petitioner has submitted that the petitioner is innocent and has not committed any offence. In fact the petitioner is not named in the F.I.R. and there is no eye witness to the alleged occurrence. Moreover, the co-accused Sone Lal Thakur, has already been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 14328 of 2017. The case of this petitioner is on better footing to the co-accused, Sone Lal Thakur. The petitioner is rotting in custody for the last three months.
Considering the nature of accusation, let the petitioner,
Patna High Court Cr.Misc. No.16154 of 2017 (3) dt.15-05-2017 above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi in connection with Bathnaha P.S.
