JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 04-11-2022 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State through Virtual Court Proceedings.

Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Kaluahi P.S. Case No. 135 of 2021 registered for the offence under Section 392 of the Indian Penal Code.

The accused/petitioner is not named in the F.I.R. and is in custody since 09.12.2021.

The allegation against the petitioner is to commit robbery, alongwith other co-accused persons and, while committing so taken away cash of Rs. 45,000/- (Rupees Forty

Learned counsel appearing on behalf of the petitioner submitted that petitioner is not named in the F.I.R. and his name surfaced during the course of investigation on the basis of confessional statement of co-accusd, namely, Pawan Kumar Sahni and in furtherance thereof, nothing incriminating surfaced/recovered, which may connect this petitioner, prima facie, with present occurrence of robbery. It is submitted that petitioner was not put on TIP, as yet.

It is further submitted that as petitioner is involved in 6 more criminal cases, his name was also involved in the present case and in maximum of the cases, the name of this petitioner surfaced on the basis of confessional statement, as of the present case. While concluding the argument, it is submitted that investigation in this case is complete for which chargesheet has been submitted, as such, there is no chance of tampering with the evidence. Learned APP opposes the prayer of bail.
