The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a) and 41 of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 7 litres of liquor is said to have been recovered from the house of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. He has been falsely implicated in the case because of his antecedents. He is in custody since 1.3.2021 and charge sheet has been submitted in the case.

The application for bail is opposed by learned APP for the State who submits that the petitioner is an accused from before in as many as ten cases under the Bihar Prohibition and

Having heard learned counsel for the parties and taking into consideration the facts of the case especially the petitioner having remained in custody for over 1 year and charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Warisaliganj P.S. Case no. 114 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge II-cum-Special Judge, Nawada.
