JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 02-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State.

The petitioner seeks anticipatory bail in a case registered for the offences punishable under Sections 341, 323, 307, 504, 506, 379, 436/34 of the Indian Penal Code and 27 of the Arms Act.

Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case because of involvement of petitioner's father in some of criminal cases. He has further submitted, referring to the First Information Report, that though there is allegation that the petitioner threw bomb towards the informant, but there is no allegation that it caused any injury or damage to property. Learned counsel for the petitioner further submits that on the

Patna High Court Cr.Misc. No.19293 of 2015 (2) dt.02-07-2015 single day i.e. 26.07.2014, three cases came to be instituted against the petitioner which shows that the prosecution story is motivated.

In view of the submission as above, let above named petitioner in the event of his arrest/surrender within four weeks from today in the court below, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Yadopur P.S. Case No. 75 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
