The petitioner seeks bail in a case instituted under Sections 302, 34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the accused persons including the petitioner is of committing murder of the brother of the informant.

Earlier the bail application of the petitioner was rejected vide Annexure-1 to the present application taking into account that he is the main assailant, who has caused fatal injury upon the deceased and he had absconded for more than 8 years in the present case.

Patna High Court Cr.Misc. No.10649 of 2017 (3) dt.19-04-2017 2/2 A report was called for from the trial court regarding the stage of the case. It has been reported that the case has already been committed to the Court of Sessions.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected in Atri P.S. Case No. 21 of 2007, pending in the court of Sri A.K. Singh, Judicial Magistrate, 1st Class, Gaya. The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of nine months from the date of receipt/ production of copy of this order. The District Magistrate, Gaya and the Superintendent of Police, Gaya are directed to ensure that the prosecution witnesses are produced in the court on the date fixed by the court below, so that the trial could be concluded within the stipulated period, as indicated by the court below.
