The petitioner seeks bail in Jadopur/ Yadopur P.S. case No. 61/2020 registered u/s 341, 323, 302, 504, 506,34 of the IPC.

The informant named seven persons, including the petitioner, and alleged that they all came and started digging the land of the informant. When the informant objected, Rahul Kumar threatened the informant. Sheo Narayan Sah, father of the informant, went there but all the accused persons started assaulting him with fists and slaps and stick. The learned counsel for the petitioner submits that there is omnibus allegation of assault against the petitioner. Altogether seven persons are alleged to have assaulted father of the informant. No.36464 of 2020(2) dt.30-01-2021 2/2 treatment but from perusal of the post mortem report it would appear that father of the informant got one swelling on parietal region of head and no further injury was found on any part of his body. Similarly situated accused Prayag Sah has already been granted bail vide order passed in Cr. Misc. No. 35457/2020.

It appears that seven persons are alleged to have assaulted the father of the informant but the deceased got only one injury on his head. Similarly situated accused, Prayag Sah, has already been granted bail. There is counter version and the occurrence took place on account of land dispute. Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, is directed to be enlarged on bail on her furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Jadopur/ Yadopur P.S. case No. 61/2020.
