The petitioner seeks bail in Town P.S. Case No. 727 of 2018, instituted for the offence under Section(s) 414 of Indian Penal Code, Sections 25(1-b)a, 26 and 35 of the Arms Act.

Counsel for the petitioner submits that recovered Motorccyle was not stolen one. The Motorcycle belongs to Raju Mahto who is relative of accused Ramesh Kumar @ Bhola Mahto while another Motorcycle belongs to Munna Choudhary who is relative of petitioner. He further submits that co-accused Ramesh Kumar @ Bhola Mahto has already been granted bail by coordinate Bench of this Court vide order dated 21.5.2019 passed in Cr. Misc. 33540 of 2019.

Patna High Court CR. MISC. No.37028 of 2019(2) dt.20-06-2019 2/2 Petitioner is in custody since 12.10.2018.

It is alleged in the written report that one country made pistol and three live cartridges have been recovered from possession of the petitioner.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Town P.S.
