The petitioner seeks bail in Rail Bakhtiyarpur (Fatuha) P.S. Case No.108 of 2016 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It has been submitted that 108 pouch of the country made liquor has been recovered from the bag in possession of this petitioner. It is mentioned in paragraph 3 of the petition that the petitioner has no criminal antecedent. He is said to be in custody since 19.10.2016.

In such circumstances, keeping in view the clean antecedent of the petitioner and period spent by him in custody, prayer for bail of the petitioner is allowed. Let the petitioner,

Patna High Court Cr.Misc. No.7235 of 2017 (2) dt.01-03-2017 above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M, Railway, DistrictPatna in connection with Rail Bakhtiyarpur (Fatuha) P.S. Case No.108 of 2016 corresponding to G.R.No.630 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
