2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 313, 385,

Patna High Court CR. MISC. No.47358 of 2024(2) dt.19-08-2024 2/3 506/34 of the Indian Penal Code.

As per the prosecution case, the allegation against the petitioners are that they entered into the house of the informant and assaulted with lathi on her abdomen and private part resulting in miscarriage and further allegation is of demanding Rs. 5 Lakh as extortion from the informant. 4.

Learned counsel appearing for the petitioners are innocent and have falsely been implicated in this case. The petitioner no. 1 is the husband, petitioner nos. 2 and 3 are brother in law, petitioner nos. 4 & 5 are father in law, petitioner no. 6 is grandfather in law, petitioner no. 7 is mother in law and petitioner nos. 8 & 9 are sister in law and petitioner nos. 10 and 11 are other relatives. It seems that prior to the present case, petitioner no. 1 has filed Matrimonial Case No. 55/2023 against the informant as per Hindu Marriage Act. There is case and counter case between the petitioners and the informant. Only with a view to harass the petitioners one after another, cases are being lodged by the informant due to matrimonial discard between the parties. The petitioners have one criminal antecedent and they are on bail in that case. 5.

Learned A.P.P. for the State has opposed the prayer for grant of anticipatory bail to the petitioners.

Considering the aforesaid facts of the case, this anticipatory bail is allowed, let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., East Champaran at Motihari in connection with Dhaka P.S. Case No. 593/2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Ranjeet/- U T
