JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-09-2019 This is an application for grant of anticipatory bail in connection with Sidhwalia P.S. Case No.56 of 2019, disclosing offences under Sections 406 and 409 of the Indian Penal Code. Allegation against the petitioner no.1, who happens to be the worker of Jeevika Mahila Sansthan and she was to arrange the meeting of its groups and to keep accounting of the amount. A sum of Rs.6,30,000/- was allotted to the Jeevika but the petitioner neither conducted meeting nor maintained the account of the same. Further allegation is that when it was asked from the petitioner to clear the account of transaction, but her father has threatened to face consequences.

Submission of the learned counsel for the petitioners

Patna High Court CR. MISC. No.35866 of 2019(4) dt.13-09-2019 2/2 is that they have falsely been implicated in this case. There is no case of defalcation against them and they are ready to abide by any condition imposed upon them.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned A.C.J.M.-VI, Gopalganj, in connection with Sidhwalia P.S. Case No.56 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that they have to co-operate the investigating agency and appear as and when required.
