24-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Forbesganj P.S. Case No. 287 of 2021, registered for the offence under Section 363, 366A of the Indian Penal Code.

As per the prosecution case, this petitioner alongwith other FIR named accused persons have abducted the daughter of informant.

It is submitted on behalf of petitioner that after recovery of the victim, her statement was recorded under Section 164 Cr.P.C. wherein she has stated that she left her house under anger and no one has kidnapped her nor forced her for marriage. The victim has disclosed her age, as 19 years and the learned court below has also assessed her age to be 18 years. Petitioner is in custody since 25.04.2021.

Patna High Court CR. MISC. No.49763 of 2021(2) dt.24-11-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as statement of the victim girl recorded under Section 164 Cr.P.C., the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in connection with Forbesganj P.S. Case No. 287 of 2021.
