The petitioner seeks bail in Thawe P. S. Case No 26 of 2019 instituted for the offence under Section(s) 399, 402, 413 and 414 of the IPC and Sections 25(1-b)a, 26 and 35 of the Arms Act.
In the written report it is alleged that police got confidential information that some miscreants have assembled near Primary School, Khanpur and making plan to commit crime. Police went to the place of occurrence. It is further alleged that persons sitting there tried to run away on seeing the police party. It is further alleged that few persons managed to run away. Police found one country made loaded pistol was
Patna High Court CR. MISC. No.37563 of 2019(2) dt.25-06-2019 2/2 lying at the place where all the persons were sitting. Petitioner and other two persons were apprehended. It is alleged that on search one knife, one country made pistol, motorcycle and mobile with SIM was recovered from possession of this petitioner.
Petitioner is in custody since 19.2.2019 having clean antecedent.
Considering the period of custody and clean antecedent of petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM, Gopalganj in connection with Thawe P.
