This petition has been filed on behalf of the petitioner for extension of time to surrender before learned Additional Chief Judicial Magistrate-III, Jamui in connection with Laxmipur P. S. Case No. 98 of 2017.

Submission on behalf of the petitioner is that due to his ailment, petitioner could not surrender before the concerned court in time.

The perusal of order dated 14.12.2018 passed in Cr. Misc. No. 59525 of 2018 goes to show that the petitioner was granted privilege of bail in Laxmipur P. S. Case No. 98 of 2017 with direction to surrender before the concerned court within

Patna High Court CR. MISC. No.42748 of 2019(2) dt.26-02-2020 2/2 four weeks from the date of receipt/production of a copy of the aforesaid order. However, it is informed that the petitioner filed the present modification petition in the month of May, 2019. Considering the aforesaid facts and circumstances as well as submission of the parties, further six weeks' time is granted to the petitioner to surrender before the learned Additional Chief Judicial Magistrate-III, Jamui in connection with Laxmipur P. S. Case No. 98 of 2017.

It is made clear that if the petitioner do so, the concerned court shall pass appropriate order in the light of the order dated 14.12.2018 passed in Cr. Misc. No. 59525 of 2018. Accordingly, the order dated 14.12.2018 stands modified to the above stated extent and this modification petition stands disposed of.
