Petitioner is accused in connection with Bairgania P.S. Case No. 30 of 2017 registered under Sections 272, 273 of the I.P.C. and section 30A of the Excise Act. Learned counsel for the petitioner submits that petitioner has been implicated in this case falsely due to enmity. The alleged recovery is from a motorcycle, and nothing has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 09.02.2017.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on

Patna High Court Cr.Misc. No.16004 of 2017 (2) dt.07-04-2017 2/2 furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Bairgania P.S. Case No. 30 of 2017.
