JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 10-11-2025 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State duly assisted by learned counsel for the informant.

2. The accused/petitioner is named in the FIR and apprehending his arrest in connection with Muffassil P.S. Case No.3 of 2025 registered under Sections 318, 64 and 316(2) of the Bhartiya Nyaya Sanhita, 2023 (in short 'B.N.S.').

3. The present FIR is found upon Complaint Case No.1945 of 2024, wherein it is alleged that this petitioner on false pretext of marriage established physical relationship with the complainant, who is already married and mother of

Patna High Court CR. MISC. No.37313 of 2025(5) dt.10-11-2025 2/3 two children. The age of complainant was disclosed as 35 years.

4. It is submitted by learned counsel appearing for the petitioner that upon facial narration of complaint, it can be gathered safely that it is a case of extra marital affairs. It is submitted that the complainant is already a married woman, having two children and, therefore, pressurizing this petitioner for marriage was not legally justified. It is submitted that allegation of theft is only to aggravate the allegation. The petitioner claimed clean antecedent.

5. Learned APP duly assisted by Mr. Sanjeev Kumar Singh, learned counsel appearing for the informant while opposing the prayer of bail submitted that the allegation as to commit rape is specifically available against this petitioner.

6. In view of aforesaid factual submissions and by taking note of fact as complainant herself is a 35 years old married woman, who prima facie shown her desire to marry petitioner, suggesting that this is a case of extra marital affairs, accordingly, the petitioner, above-named, who is a

No.37313 of 2025(5) dt.10-11-2025 3/3 man of clean antecedent, in the event of his arrest or surrender in the court below within a period of four weeks from today, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Katihar in connection with Muffassil P.S. Case No.3 of 2025, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure (in short 'CrPC')/under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita, 2023 (in short 'BNSS').
