JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 29-04-2015 This application under section 482 of the Code of Criminal Procedure has been filed for modification of the order dated 10.04.2015 passed in Cr.Misc. No. 46352 of 2014, whereby the petitioner has been directed to be released on bail to the satisfaction of Sanjay Kumar, learned Judicial Magistrate, Purnea. It has been contended that due to inadvertence while drafting application for bail the counsel for the petitioner could not notice the apparent error in the name of the Presiding Officer before whom the matter is pending as a result of which the name is typed as Sanjay Kumar in place of Ajay Kumar. Consequently by order dated 10.04.2015 the petitioner has been directed to be released to the satisfaction of Sanjay Kumar in place of Ajay Kumar. Learned counsel for the petitioner contends that the matter is pending before Sri Ajay Kumar, learned Judicial Magistrate,

Patna High Court Cr.Misc. No.19803 of 2015 (2) dt.29-04-2015 2/2 Purnea.

Learned counsel for the State has no objection to the prayer made on behalf of the petitioner.

Accordingly, the application is allowed. In the order dated 10.04.2015 passed in Cr.Misc. No. 46352 of 2014 at page-2, the name of the Presiding Officer be read as 'Sri Ajay Kumar' in place of 'Sanjay Kumar'.

Learned counsel for the petitioner is also permitted to make necessary correction in the prayer portion of the bail application.
