Petitioner apprehends his arrest in Kochadhaman P.S. Case No.79 of 2019, registered under Sections 341, 354(A)(B) and 506 of the Indian Penal Code as well as under Section 8 of the POCSO Act.

The petitioner is alleged to have caught the minor daughter of the informant while she had gone to cut grass and made an abortive attempt to commit rape with her after taking her in a maize field. On alarm, many persons present in the vicinity of the occurrence came and save the minor victim. Learned counsel for the petitioner submits that petitioner is next door neighbour of the informant. The parties have compromised the case.

No.40649 of 2019(2) dt.02-07-2019 2/2 Taking into consideration the facts and nature of allegations made against the petitioner that the petitioner made an abortive attempt to commit rape with a minor victim after forcibly taking her inside a maize field, I am not inclined to enlarge the petitioner on anticipatory bail.

Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
