The Petitioner apprehends his arrest in connection with Saraiya (Jaitpur OP) Police Station Case No 5 of 2013 instituted for the offence under Sections 341, 323, 366A, 504/34 of Indian Penal Code.
As per allegation in the written report, the petitioner performed marriage with the daughter of the informant on 03.01.2013. Thereafter, he forcibly sent the daughter of the informant to Naihar and did not become ready to keep her. Today, during the course of hearing of the bail petition, petitioner has stated that he is ready to keep the daughter of the informant as his wife.
Patna High Court Cr.Misc. No.9603 of 2017 (4) dt.05-05-2017 2/2 Learned counsel for the informant has appeared and has stated that the daughter of informant is ready to live with the petitioner.
In the facts and circumstances of the case, the petitioner is directed to file undertaking in the Court below (Sub Divisional Judicial Magistrate, Muzaffarpur) that he will keep the daughter of the informant with all dignity and honour and in that event, the Court will grant provisional bail to the petitioner in connection with Saraiya (Jaitpur OP) Police Station Case No 5 of 2013 for nine months on furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) to his own satisfaction and after release of the petitioner, will monitor the relationship by calling both of them in Court every month and in the event, the Court below will be satisfied that the petitioner is keeping the daughter of the informant with full care and dignity and there is no complaint made by the daughter of the informant, the Court below will confirm the provisional bail of the petitioner after nine months.
