1. Heard learned counsel for the parties.
2. The petitioner in this application prays for bail apprehending his arrest in connection with Bihiya P.S. Case no.393 of 2024 registered for the offence punishable under sections 126(2), 115(2), 118(1), 352, 109(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, the informant states that on the date of occurrence, Guddu Yadav and Biku Yadav came variously armed and started to abuse and assault his son with a knife. The informant's son sustained injury on his head. It is further stated that on the same day in the evening, the four named accused persons including the petitioner herein came variously armed. It is further stated that Abhishek Yadav struck on the informant's head with a farsa causing injuries. The

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. Accepting the allegations levelled in the FIR for the sake of argument, no overt act has been alleged against this petitioner. He undertakes to cooperate in the investigation/trial.
5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner in the FIR and specially no overt act having been alleged against him, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Bihiya P.S. Case no.393 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Bhojpur at Ara.
