JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 03-05-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner has prayed for bail in a case registered for the offence punishable under section 354(B) of the Indian Penal Code and section 8 of the POCSO Act.
Prosecution case relates to outrage the modesty of the informant's minor daughter by the petitioner. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. From perusal of the case diary vide para-5, the statement of the victim girl recorded u/s 161 Cr.P.C. before the I.O., She has not stated about physical misbehave or physical assault by the petitioner. There is no complain or information regarding misbehavior by the petitioner. He has got no criminal antecedent and petitioner is languishing in judicial custody since 16.3.2021.

Having heard learned counsel for the parties and considering the period of custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-VII-cum-Exclusive Special Court (POCSO ACT), Patna in connection with Punpun P.S. Case No. 262 of 2020.
