2. The petitioner seeks regular bail in connection with Bairiya P.S. Case No. 142 of 2026, registered for the offence under Sections 329(3), 126(2), 352, 115(2), 118(1), 109(1), 103(1), 76, 61(2) and 3(5) of the B.N.S.

3. As per the prosecution case, the petitioner is the father of the deceased and another son of the petitioner is the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. Learned counsel submits that the occurrence took place due to land dispute and the petitioner being father of both the deceased

Patna High Court CR. MISC. No.41403 of 2026(2) dt.25-06-2026 2/2 and the informant has been made accused in this case. There is counter case also. The petitioner is in custody since 20.03.2026.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Bairiya P.S. Case No. 142 of 2026, subject to the conditions as laid down under Section 482(2) of the B.N.S.S.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
