The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 148, 149, 342, 307 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act. Later on, Section 302 of the Indian Penal Code was added in F.I.R.
As per the F.I.R., the accused persons including petitioner armed with various weapons attacked on the son of the informant, due to which, he sustained severe injuries, as a result of which, during treatment, he died.
It is submitted on behalf of petitioner that there is general and omnibus allegation and no specific overt act has been alleged against this petitioner. Similarly situated coaccused Asha Rani and Sarvesh Singh have been granted bail by
Patna High Court CR. MISC. No.49178 of 2021(2) dt.21-06-2022 2/2 this Court, vide order dated 11.03.2022 passed in Cr.Misc. No. 46447 of 2021 and order dated 10.02.2022 passed in Cr.Misc. No. 62268 of 2021 respectively. Petitioner claims clean antecedent.
Learned A.P.P. for the State and learned counsel for the informant vehemently opposes the prayer for anticipatory bail of petitioner.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai in connection with Sahebpur Kamal P.S. Case No. 95 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
