JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 22-04-2015 The present application has been filed for modification of order dated 26.02.2015 passed in Cr. Misc. No. 7485 of 2015 whereby petitioner was granted anticipatory bail in Korha P.S. Case No. 191 of 2014 registered for the offences punishable under Sections 341, 323, 324, 325, 504 of the Indian Penal Code and Section 3(1)(x) of SC/ST (Prevention of Atrocities) Act, pending in the court of learned Chief Judicial Magistrate, Katihar.
The main point for grant of anticipatory bail was the statement in para 8 of the petition that the informant has received no injury. Though, bail bonds of the petitioner shall be accepted by the learned court below after verification of the fact that no injury was actually caused to the informant. It was
Patna High Court Cr.Misc. No.14471 of 2015 (02) dt.22-04-2015 2/2 stipulated in the order that if any injury will be found then the petitioner will surrender before the learned court below and pray for regular bail.
It is submitted by learned counsel for the petitioner that the injury has been found to be simple. In view of the conditions stipulated in the order dated 26.02.2015 the present modification application is not maintainable.
Let the learned court below consider the prayer for regular bail of the petitioner, if he surrenders before the learned court below within a period of four weeks from today in view of the fact that the injury has been found superficial simple in nature.
