Petitioner, already in custody, seeks bail in connection with Chandan (Anandpur) P.S. Case No.87 of 2017 registered under Sections 25(1-b)a, 26 and 37 of the Arms Act. Allegation in brief is that at the instance of the petitioner leading to his confession, a country made pistol with one live and one spent cartridge were recovered from the bush by the side of the road.

Learned counsel for the petitioner submits that petitioner has been falsely implicated on account of rivalry in panchayat election by another rival group and the petitioner was supporting the another group in the panchayat election; whereas the learned counsel for the State submits that at the instance of

Patna High Court Cr.Misc. No.26982 of 2018(3) dt.10-07-2018 2/2 the petitioner leading to his confessional statement, arms and cartridges were recovered and the petitioner has a large number of criminal antecedents. The report of the trial court indicates that charge too has not been framed.

Having considered the aforesaid facts and circumstances, the prayer of bail of the petitioner is rejected. However, the petitioner may renew his prayer of bail after six months.
