Petitioner seeks regular bail in a case registered for the offence punishable under Section 413, 414/34 of the Indian Penal Code.

As per the prosecution case, petitioner was apprehended with stolen motor cycle of informant. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that some altercation has taken place between Raju Kumar Gupta, owner of the said motor cycle, and this petitioner and Raju Kumar Gupta runs a shop in local market and has good relation with local police and taking advantage of the same he implicated petitioner in this false case. No incriminating article has been recovered from the possession

Patna High Court CR. MISC. No.49184 of 2021(2) dt.24-11-2021 2/2 of the petitioner and he has been made accused on the basis of his criminal antecedent. Petitioner is in custody since 09.06.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Anupma Kumari, Judicial Magistrate, 1st class, Saran at Chapra in connection with Mashrakh PS case No.306/2021.
