The petitioners seek anticipatory bail in a case registered for an offence punishable under Sections 304/120B of Indian Penal Code.
Allegedly, the informant had got admitted his younger
Patna High Court Cr.Misc. No.41960 of 2014 (2) dt.04-03-2015 2/2 brother's wife for surgery in Raja Health Care Centre where she died. The petitioner in Cr. Misc. No. 41960/14 is a Doctor in the said Raja Health Care Centre whereas petitioner in Cr. Misc. No. 43795/14 is an employee there. Suspecting carelessness of these persons to be the reason for the death of the informant's younger brother's wife, he got instituted the F. I. R. From the F.I.R., I do not find any material to show that the negligence on the part of the petitioners was the reason behind the death of the deceased. Considering the facts and circumstances, in case of arrest or surrender within a period of four weeks, the above named petitioners shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand)each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Town P. S. Case No. 120 of 2014, subject to condition as laid down under Section 438( 2) of Cr. P.C. (Chakradhari Sharan Singh, J) Sudha/- U T
