The petitioner seeks bail in Banka P.S. case No.140 of 2016 (Sessions Trial No.197 of 2016) registered under Sections 304(B)/34 of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act, pending in the court of IInd Additional District & Sessions Judge, Banka.
Allegation is that the accused persons including the petitioner committed murder of the daughter of the informant due to non-fulfilment of demand of dowry.
The earlier bail application of the petitioner was rejected vide Annexure-1 to the present application taking into account that he was the husband of the deceased and the onus was on him to explain the cause of death of the deceased.
Patna High Court Cr.Misc. No.12580 of 2018(3) dt.26-04-2018 2/2 A report was called for from the Trial Court regarding the stage of the case. It has been reported that the trial is at the stage of argument and it is likely to be concluded within a period of one month.
Considering the aforesaid facts and circumstances and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected. The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of two months from the date of receipt/production of a copy of this order.
