The petitioner seeks pre-arrest bail in connection with Complaint Case No. 617 of 2018 in which summoning order has been issued for the offence punishable under section 498 A of the Indian Penal Code.
The report would reflect that the matter could not be settled in mediation.
Learned counsel for the petitioner has contended that the complainant was neither subjected to any cruelty nor any
Patna High Court CR. MISC. No.37298 of 2019(5) dt.16-11-2019 2/2 unlawful demand was made from her or her parents. However, the complainant herself is a quarrelsome lady by nature and she has refused to live with the petitioner.
On the other hand, learned counsel appearing for the complainant submitted that from the date of marriage itself, the complainant was subjected to cruelty for non-fulfilment of demand of an Alto car in dowry.
Considering the nature of allegation and the plea taken before the Court, in the event of arrest or surrender before the court below, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-XII, Saran at Chapra in Complaint Case No. 617 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
