2. The petitioner is named in the F.I.R. and apprehending his arrest in connection with Kotwali P.S. Case No. 48 of 2026 registered for the offences punishable under Sections 69 of the BNS.
3. The allegation against petitioner is to establish physical relationship on false pretext of marriage.
4. It is submitted by learned counsel appearing on behalf of the petitioner that informant is 26 years old married and working lady. It is argued that admittedly her relationship with husband was strained for which she filed a divorce petition,

It is submitted that knowing her status that she could not marry with this petitioner, she established physical relationship with petitioner, who is also a married person. It is submitted maximum it is a case of extra marital affairs. Petitioner claimed clean antecedent.
5. Learned APP opposes the prayer of bail.

In view of aforesaid factual submission and by taking note of fact as factual aspect of this case prima-facie suggest maximum of extra-marital affair of petitioner with informant, accordingly petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Darbhanga/concerned Court, where the case is pending in connection with Kotwali P.S.
