The petitioner apprehends his arrest in connection with C.A. Case No.193 of 2014 registered under Sections 418, 420, 422 and 406 of the Penal Code, pending in the court of the Chief Judicial Magistrate, Purnea.
The allegation against the petitioner is of purchasing the potato from the complainant and 17 others worth Rs.4,00,000/- (Rupees Four Lacs) in the month of February, 2013 but the petitioner did not pay the price of the potato to them in spite of repeated demand and also refused to pay the same.
Patna High Court Cr.Misc. No.42842 of 2014 (2) dt.27-03-2015 2/2 Having considered the facts and the circumstances of the case and nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for anticipatory bail stands rejected. However, it is made clear that the trial court shall not be prejudiced by the order of this Court at the time of considering the regular bail prayer of the petitioner.
