Petitioner, already in custody, seeks bail in connection with Udwantnagar PS Case No.295 of 2016, giving rise to NDPS Case No.16 of 2016, registered under Sections 20(b)(i) (c)/22(c) of the NDPS Act.

Allegation in brief is that from the car in which the petitioner along with another co-accused was travelling, 94 Kgs. of Ganja was recovered.

Learned counsel for the petitioner submits that one of the accused apprehended from another vehicle from which 24.350 Kgs. of Ganja was recovered disclosed that they were bringing Ganja from Raipur and he has been granted bail by a

Patna High Court Cr.Misc. No.15229 of 2018(3) dt.10-05-2018 2/2 coordinate Bench of this Court vide Cr. Misc. No.20551 of 2017 on 30.06.2017. However, the case of the petitioner stands on different footing as the recovery from the vehicle from which the petitioner was travelling, huge quantity of Ganja was recovered.

Having considered the aforesaid facts and circumstances as well as the recovery of commercial quantity of Ganja, the prayer of bail of the petitioner is rejected and the trial court is directed to expedite the trial.
